Lara Bingle and Sam Worthington will be grilled about last year's street stoush with a New York paparazzo - just days after welcoming their first child.

A US judge has ordered the Australian celebrity couple be deposed no later than April 10 by the lawyers of photographer Sheng Li, who has filed a $US10 million ($12.9 million) lawsuit.

Bingle, a model and fashion designer, and Rockingham-raised Worthington, star of blockbuster film Avatar, confirmed last week their son was born at Los Angeles' Cedars-Sinai hospital.

"Defendants shall be deposed not later than April 10, 2015," US District Judge Lorna Schofield wrote in her order.

Li alleges he was "viciously assaulted and battered" by Worthington and Bingle "without any just cause or provocation" on a Manhattan street on February 23 last year.

The photographer claims he suffered a shoulder tendon tear and injuries to his right thumb, wrist, facial contusions, abrasion, lacerations, mental anguish and post- traumatic stress.

With Bingle's pregnancy in Los Angeles grounding her, Judge Schofield ruled the couple should pay for Li's lawyer to travel to California.

The couple, above, will pay for one economy return airfare, one night in an LA hotel and travel time for a lawyer at $US300 per hour.
