Aunt unsuccessfully sued 12-year-old nephew for $127,000

A New York woman sued her nephew for $127,000 after the eight-year-old leapt into her arms resulting in her breaking her wrist.

Jennifer Connell claimed her nephew Sean Tarala, now 12, acted unreasonably and caused her to fall to the ground resulting in her breaking her wrist.

In the witness stand she stated her love for her nephew, however she believed the boy should be held accountable for her injury to the tune of $127,000.

She went on to describe her nephew as “very loving and sensitive” towards her.

The incident occurred four years ago at the boy's birthday party. The birthday boy had just received his new red two-wheeler bike as a gift and was cycling around when he spotted his Aunt Jennifer, according to court testimony.

He then dropped the bike and ran over to her exclaiming: “Auntie Jen, Auntie Jen.”

Connell said: “All of a sudden he was there in the air, I had to catch him and we tumbled onto the ground.”

She also said the boy weight of 23kg was a contributing factor to the fall. She also said she didn’t complain about the injury at time.

“It was his birthday party and I didn’t want to upset him,” she told the jury.

Sean was accompanied by his father, Michael Tarala in court. His mother Lisa, died last year.

Connell maintains her life was turned upside down as a result of the injury.

“I live in Manhattan in a third-floor walk-up so it has been very difficult,” she said.

Much to the delight to many on Twitter following the case, the jury deliberated for just 25 minutes before unanimously ruling in favour of the nephew.
