Deadly driver handed community corrections order

The family of a mother and daughter killed in a Victoria car crash say they are devastated the man who caused the accident won’t be sent to jail.

The 22-year-old driver Stephen Borg was driving on the wrong side of the highway in Rosedale when he collided head-on with another car – killing Theresa Hutchings and her young daughter Mikayla in November 2013.

Ten-year-old Andrew was left a paraplegic and suffered head injuries in the crash that took his mum and little sister.

The brave boy told media outside court: “I feel very angry and sad about all this."

Borg had faced up to twelve years jail after pleading guilty to charges including dangerous driving causing death.

Instead he was given a community corrections order of 500 hours over five years and was banned from driving for two years.

Robert Hutchings said: "Five years and he is still out in the community.

"He might not be a danger but five years, two lives and where we are at now."

Borg was found to be fatigued from juggling two jobs.

Speed, alcohol or drugs were not factors.

The Hutchings family have not returned to the crash scene and say they have no intention to do so.

Borg avoided jail on the basis that he pleaded guilty and has an intellectual disability and had no prior convictions.

But it was left to his family to express remorse.

The Hutchings family will be seeking an appeal on the basis the sentence was too light.

Andrew added: “I miss my mother and sister a lot.”
