Woman fined $3,600 for 6km road mistake: 'Bit excessive'

A Melbourne woman has shared her shock at the exorbitant fine she received after being caught speeding just 6km over the limit in her company's car, incredulous at the amount.

"A bit excessive, no?" TikTok user Jane Agirtan captioned a video of the fine.

"$3635 for 6km over the speed limit".

Although the fine was a surprise for Ms Agirtan to receive, users were quick to deduce that she was driving a corporate vehicle, meaning the fine will be heavily reduced once she nominates herself as the driver.

According to the fines Victoria website, for some offences, company vehicles are issued with a body corporate infringement notice, which is much larger than the fine given to an individual.

It's designed to incentivise companies to out the driver behind the wheel.

"This larger amount is to encourage companies to nominate the responsible driver, so that demerit points can be applied to their licence," the website explains.

"As companies do not have a driver licence on which to apply demerit points, an authorised officer of the company must therefore nominate the person who was driving."

Fines Victoria says once a nomination is accepted, that driver will receive a new fine in their name and the demerit points and payable amount — which would be significantly lower — will be applied.

"Once nominated, the fine is reissued to the driver at the amount relevant to the offence (for example $227 for full licence holders caught speeding by less than 10km/h)," Fines Victoria explained.

"If a company fails to nominate a driver, it is liable to pay a penalty of $3,365."

However, if a company fails to nominate a driver three or more times within a 12-month period they will be liable for a fine over $21,000.
