Despite the horrific attacks, a magistrate handed Mr Thomas a suspended sentence.

The attacks happened in the early hours of the morning in Claremont earlier this year.

The court was told the 20-year-old reacted impulsively after Mr Ortiz spat at his feet, but the victim has denied that happened.

"There was a concrete wall behind me that had a sharp edge to it and if I was about 30 centimetres backwards, I could've landed straight on that and it could've killed me," Mr Ortiz told Seven News in June.

Just 15 minutes later, Mr Thomas was involved in a second one-punch assault in the same area.

That punch knocked a 19-year-old man to the ground and left him with a black eye.

For both assaults, Mr Thomas was handed a 12-month suspended jail term.

His second victim spoke today on Tuesday.

Still traumatised by the attack, he didn't want his identity revealed.

"There's just no repercussions for your actions any more," he said.

"It's breeding a bit of a scum society in the city."

Mr Ortiz says he was expecting his attacker to go to jail and said the sentence was "appalling".
