Terms and Conditions

1. Instructions on how to enter, prize details and other information contained within the competition advertisement, form part of these terms and conditions. By participating, in this competition entrants agree to be bound by these terms and conditions.

2. The promotion commences on Thursday February 19, 2015, and closes noon Monday August 24, 2015. Only entries received by this date and time will be valid and entries MUST be submitted via:

Email – send to bestpicture@wanews.com.au. Entrants must provide their full contact details and a caption explaining where the photo was taken. Email digital pictures individually, as JPEG files between 500KB and 1MB.

3. Subject to clause 14, entry to the prize draw is open to all residents of Western Australia over the age of 18, who are amateur photographers only. Photographic identification may be required upon collection of the prize.

4. Photographs submitted must be the entrant's own original work and must not have been published previously or been obtained from a secondary source. Entrants should not be digitally enhanced. By submitting a photograph/video, an entrant grants West Australian Newspapers Limited, and its related entities a royaltyfree, perpetual licence to use, reproduce, publish or display the photographs/videos and any stories on the entrants. This includes commercial purposes and may extend to or involve use by or with one or more third parties.

5. There is a limit of four images per entrant will be accepted.

6. Photographs submitted will be displayed on thewest.com.au and published in The West Australian. West Australian Newspapers Limited accepts no responsibility for materials submitted and advises that entries submitted will not be returned to entrants.

7. Photographs that feature any corporate advertising material or messages will be disqualified from entry.

8. The Prize will be awarded to the best picture (one prize winner) submitted over the 6 month competition period as judged by the Judging Panel. All entries will be judged and rated by the Judging Panel. The judges’ decision is final and cannot be contested.

9. The Prize is one cruise for two in an Inside cabin from Fremantle to Singapore, departing 23 February 2016, 3 nights accommodation in a 4-star Singapore hotel and airfare from Singapore to Perth, booked through Holiday Planet. Proof of ID may be required from the winner at check-in to the hotel, for all incidental charges.

After 1 month if prize unclaimed, winner has forfeited their right to the prize and prize will be redrawn no sooner than 3 months after the first draw date. In the event of cancellation by the winner, for whatever reason, no alternative prize or travel dates will be offered. Once a confirmed booking has been made, reservations may not be changed and standard booking terms and conditions apply.

10. Prize value is $5,000. Prize must be taken as supplied and is/are neither redeemable for cash nor transferable. All components of the prize must be taken at the same time. No responsibility is accepted for any variation in the value of the prize.

11. All additional costs incurred will be at the expense of all the prize winners. Spending money does not make part of the prize. The prize winner and companion are responsible for obtaining all necessary travel documents (eg. passport, visa) and complying with all health or other government regulations. 12. It is a condition of entry that all prize winners agree to have their name and suburb published for publicity purposes if required. By participating in this competition, participants signify their acceptance of all conditions and the requirement to participate in promotional activity if required.

13. Employees of West Australian Newspaper Limited, their associated agencies and immediate families, are ineligible to enter.

14. All contestants release from, and indemnify West Australian Newspaper Limited against, all liability, cost, loss or expense arising out of acceptance of any prize(s) or participation in the competition including (but not limited to) loss of income, personal injury and damage to property and whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise.

15. West Australian Newspaper Limited and associated agencies accept no responsibility for any loss, damage, accident, death or injury resulting from the promotion.

16. Entry into this competition signifies acceptance of all conditions. The Promoters’ decision will be final and cannot be contested. No correspondence will be entered into. The Promoters reserve the right to limit entry or amend rules if considered necessary without notice.

17.
