'Ask Tony' Seven News promotion - Terms and Conditions

By submitting entry material to the ‘Ask Tony’ Seven News promotion, you are agreeing to the following terms and conditions.

1. WHO CAN ENTER?

1.1 Entry into the promotion is open to a teacher, educator, or nominated representative of any Queensland primary school, aged 18 years or older.

2. HOW TO ENTER

2.1 To enter you must submit a video question of ten seconds or less, in which students from a Queensland primary school ask a weather question, to be broadcast on Seven News, for weather presenter Tony Auden to answer.

2.2 Your entry must be submitted to: asktony@seven.com.au via an official school email address, along with your name, role within the organisation, and full contact details.

2.3 Entries may be recorded on a smartphone or digital camera in landscape frame. A mov.file is preferred, no larger than 12MB.

2.4 You MUST have the written permission of any individual depicted in the video. With specific reference to school children appearing in the video, you must have written consent from each child’s parent/guardian, authorising Seven Network’s use of the material.

2.5 You MUST own the copyright in any video material you upload (or otherwise be entitled to use the video material in this way)

2.6 By submitting, posting or displaying your video upload to asktony@seven.com.au, you grant Seven a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such content in any and all media or distribution methods (now known or later developed).

3. SELECTED ENTRIES

3.1 Entering a video question does not guarantee the use of the video question within the ‘Ask Tony’ promotion. The Seven Network determines at its sole discretion which entries shall be shown as part of the promotion.

4. WARRANTIES

*4.1 Entrants agree that they are fully responsible for any materials they submit. The Promoter shall not be liable in any way for such content to the full extent permitted by law. Entrants warrant and agree that:*

a) they will not submit any content that is unlawful or fraudulent, or in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
b) their content shall not contain viruses or cause injury or harm to any person or entity;
c) they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content;
d) they are the parent or legal guardian of any child and/or children appearing in any Content, or have obtained and give consent to the use of the Content for the purposes described in these terms and conditions;
e) they are the owner of copyright in the Content, or they have obtained full prior consent from any person who has jointly created or has any rights in the Content, and the Content does not infringe the rights of any third party;
f) they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and
g) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.

5. NO LIABILITY

5.1 Seven Network (Operations) Limited and their associated agencies and companies will not be liable for any claims, misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur including, but not limited to:
a) in preparing a video question for entry into the promotion;
b) due to the broadcast of any program relating to the promotion or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;
c) in relation to failure of an entry to be received by the Promoter on account of technical problems or traffic congestion; or
d) in relation to any damage or loss to Entrant's or any other person's computer software, computer equipment or internet connection resulting from or related to participation in this Promotion;
e) any technical difficulties, technical error or equipment malfunction (whether or not under the Promoter’s control); or
f) any error, omission, interruption, deletion, delay, defect, theft, unauthorised access or third party interference.

6. PROMOTER’S DETAILS

6.1 The Promoter is Seven Network (Operations) Limited (ABN 65 052 845 262) of Level 2, 38-42 Pirrama Road, Pyrmont NSW 2009.

Entry details remain the property of the Promoter. Seven will handle your personal information in accordance with Seven’s Privacy Policy which is available on our website (and which contains information regarding how you can access your personal information, correct it and/ or make a complaint about our handling of your personal information). By providing your personal information below, you agree to the terms of the Privacy Policy. Without limiting the foregoing, Seven may disclose the entrant’s personal information to its related entities, business partners and external service providers for research and profiling purposes as well as other purposes reasonably related to the entrant’s relationship with Seven. In addition, by entering this competition, you consent to Seven using your personal information for the purpose of Seven and its related entities sending you information regarding programs, products and services available through them and/ or through their business partners, and to Seven from time to time sharing your personal information with carefully selected business partners for the purpose of them sending you such information directly.
