Newly weds sue over photo fail

A newlywed couple has taken legal action against photographers for failing to capture the money shot - the matrimonial kiss - on their wedding day.

Jarrad and Sheree Mitchell commissioned Studio Edge & Multimedia, of Beaconsfield, $2,600 to photograph the big day at Nathania Springs, near Belgrave, on August 28, 2011.

But the photo album became the subject of a Victorian Civil Administrative Tribunal (VCAT) after the Narre Warren couple claimed some of the most romantic moments on the day, including 'the kiss' and the cutting of the ribbon, had been missed, Fairfax reports.

The hearing heard the Mitchells refused to pay the full contract fee and demanded a further $6,400 in damages, arguing photos were also poor quality, with blurred movement and shadows obscuring shots.

Fairfax reports snapper George Ferris refuted the couples' claims insisting the smooch had not lasted long enough to shoot.

The photographers counter-claimed for $5,700, demanding the outstanding contract amount, costs for the case and a penalty fee for supplying a second photographer at the wedding reception.

VCAT ruled it was not always possible for wedding photographers to capture pivotal moments during the day.
