Motorist who copped $129 fine for parking at popular beach divides Aussies

The space sits within a car park but is not marked like the other spots, sparking a heated debate among confused locals.

A simple car park photo has divided Aussies who cannot agree on whether the spot is legal after a motorist was fined for parking there.

The image of the space, which sits inside the car park south of South Maroubra surf club in Sydney, was shared online with the poster asking if anyone else had been fined for parking there. "It seems these are appropriate parking bays and no suggestion parking is not permitted?" the woman said.

Citizen detectives find parking sign

Many locals said the spot was illegal to park in because of the lack of white lines. Several people pointed out the sign at the entrance to the car park which says people can "park in bays only".

"There’s no white lines marking parking bays so would assume not permitted?!" one said. "I have parked there and got fined under that assumption. When I tried to fight it I was told no marked lines so no parking," replied another.

Others vehemently disagreed, saying that because this spot was in a car park, it was legal. "It’s a car park. Therefore you have to park in the spaces".

Council confirms it's not a legal place to park

Yahoo contacted Randwick City Council who confirmed the bay is meant for people to use while reversing in or out of surrounding car spaces and it not a car parking space — which is why there are no lines marking parking bays there.

The fine for parking in this area is $129, under Rule 211, with the offence being "not park wholly within parking bay".

Similar rules in other Aussie states

One driver in Victoria copped a fine after similar confusion, posting a photo of their car at the end of a long row of parking spaces with a painted white T on the right side of the car, but not the left. "Would you have thought this was a parking spot?" they said. "There’s no signs, and it’s not in front of a driveway. There’s no bay marking on the LHS [left-hand side]".

They claimed the offence listed on their ticket was also "parked not completely within a parking bay".
