Driver who hasn't paid tolls in years says you shouldn't have to either

Meet the Queensland man who hasn't paid a road toll since 2011.

Bob Jarvis, from the Sunshine Coast, is a passionate believer that no-one should be forced to pay road tolls, and he wants to have his day in court to prove it.

"I just don't pay - I refuse to," Mr Jarvis says of his six-year run without paying a toll.

He believes it's his constitutional right to not pay and claims the Queensland government is creating a new form of currency that is invalid.

Lawyers say he has a point - but it is arguable whether a toll is considered a tax as opposed to a fee for using something someone else has provided.

"If you enter a toll road which is well signed - you know that when you go past that sign you're entering a contract", lawyer Andrew Wiseman says.

Mr Jarvis has received many warnings for his outstanding debt but it seems the toll road provider has all but given up hope of getting its money.

In 2011 Mr Jarvis drove down the Gateway Motorway with cash to pay the toll, only to find it was no longer a payment option.

He was fined and elected to go to court, but his case was dismissed.

He says he pays his road toll through the fuel excise.

"They won't take me to court because they know damn well they'll lose the case," he says.

"How tolls are charged is lawful and consistent with the Constitution," Acting Roads Minister Steven Miles says.

"If you don't want to pay tolls, don't use toll roads."

Mr Jarvis says he is waiting for his day in court to test his anti-toll stance in front of a Magistrate .
