13-Year-Old Accused of Stabbing Mom to Death in Front of Her Newborn Will Be Charged as Adult

A 13-year-old Florida boy will be tried as an adult on a first-degree murder charge after the fatal stabbing of his mother, according to court reports.

Irina Garcia, 39, was allegedly stabbed to death in her sleep by her son, who has been identified as Derek Rosa in Miami-Dade County court records.

On Oct. 12, the teen allegedly called Hialeah, Fla., police to tell them he had killed Garcia, Local 10, NBC Miami and WSVN reported at the time, citing police.

He was arrested on the day of Garcia's death, and booked into the Metro West Detention Center on Thursday, according to jail records.

When police arrived at the scene, they found Garcia dead next to a crib where there was a two-week-old baby, who was unharmed, the outlets reported previously.

At his bond hearing on Friday, the teen's father and grandmother pleaded for him to be released on house arrest, according to NBC.

"It’s very unfortunate that this tragedy occurred, but this child is very humble, very peaceful and nobody could imagine this would ever happen," his father said in court, according to footage shared by NBC.

Rosa, who was unnamed in PEOPLE’s previous reports, was identified as a middle school honor student who was apologetic when officers arrived.

The teen is set to be arraigned on Tuesday. He will plead not guilty, his lawyer, Kristen Reynoso, says.

“He is a great kid all around,” Reynoso tells PEOPLE. “I’ve seen him interact with the staff at the Miami Dade Regional Juvenile detention center, and they hug him. The staff has also said how much they love him."

"I only know him to be sweet and respectful," she adds.

While addressing a possible motive, Hialeah police spokesperson Eddie Rodriguez told NBC at the time, "We don't know, that's something that we're still trying to figure out."

Rodriguez alleged that the teen "did not say why he did this, all he did was call 911 and advise what he did."

Garcia had given birth to Rosa’s half-sister just two weeks before the killing. According to 911 call records shared by Local 10, the teen told dispatchers that there was blood all over and asked for the police to come over. When asked his address, he said he didn't know.

The teen also allegedly said that he "took pictures and told my friends about it, was that bad?" according to the report.

When the dispatcher asked about the teen's infant sister, Rosa said she was asleep.
