Sentencing of man convicted of grievous bodily harm delayed after prosecutors raise concerns

A Hobart man found guilty of causing grievous bodily harm will not be sentenced until a separate charge of abusing police is dealt with in a lower court.

Jamie Peter Smart was found guilty of causing grievous bodily harm to Shayne Waller at a housing complex in a Hobart suburb in February 2011.

Smart was due to be sentenced in Hobart's Supreme Court today, but crown prosecutors raised concern with remarks made by defence lawyers in a previous court hearing.

The defence argued Smart was a changed man and that the judge should take that into account in sentencing.

But since then, Smart was charged with abusing police over an alleged incident on New Year's Day.

That matter will be heard in the Magistrates Court next month and the Supreme Court sentencing has been postponed until after then.

The victim, Mr Waller, has a permanent brain injury following the assault inside his unit.
