Man denied appeal bid for Victorian rape

A "predatory and opportunistic" man who got his intellectually disabled adult stepdaughter pregnant has been denied a bid to appeal against his seven-year-jail term.

The offender, then 52, was found to have raped the vulnerable woman, then 21, after a trip to the doctor in 2014. Tests revealed the woman - who has a moderately severe intellectual disability - was pregnant, he was the father, and a decision was made to terminate the pregnancy.

He argued the sentencing judge erred in finding he lacked remorse and was "predatory and opportunistic" but the Court of Appeal on Thursday rejected his bid, finding his sentence "well within range".
