Man jailed for stomping on toddler will walk free after conviction overturned

A man jailed for stomping on and killing a toddler will walk free after having his conviction overturned on appeal.

Mussie Debreysay was sentenced to more than a decade behind bars for the manslaughter of his partner's child, who was killed in 2005.

But on Thursday, Melbourne judges agreed the evidence given by the toddler's four-year-old brother could not be relied on and said they could also not rule out the mother as the killer.

"Her behaviour does show she did not value her daughter's welfare as highly as a parent ordinarily would," the County Court judge said.

"There was a reasonable possibility that it was she, and not the applicant, who inflicted the fatal blow."

They court were forced to throw out his convictions and his family were in disbelief after being told he would walk free.

They were seen throwing their hands in the air and crying as they left court.
