A Tuart Hill woman who jointly bought a property with a company has won a legal battle for the $7000 first-homebuyer's grant.

The Office of State Revenue had ruled she was not eligible and the scheme was not intended to cover that funding arrangement.

Laura Benzion purchased the Hector Street property jointly with Australian Property Investment Exchange, which offers co- ownership as a low-cost entry to the real estate market.

The State Revenue Commissioner rejected her application for the grant on the basis that the co-owner had to apply and was ineligible because it was a company.

Ms Benzion's objection to the ruling was dismissed by the commissioner.

But in a decision published earlier this month, the State Administrative Tribunal ruled in Ms Benzion's favour after finding the co-ownership agreement did not give the company a right to immediate occupation of the property and as such was not required to be an applicant for the grant under the scheme's legislation.

The Office of State Revenue is considering the full implications of the decision and whether to appeal.
