Actor Sean Penn has played down reports he is engaged to fellow Oscar winner Charlize Theron, insisting comments he made in an interview were "mixed up".

The twice-wed Milk star has been dating the Monster actress since 2013 and sparked speculation they were planning to walk down the aisle by talking about a potential third marriage last year.

However, he has now addressed the rumours and revealed his remarks were misconstrued but he pointedly stopped short of denying the couple, right, were engaged.

"I have not announced it," Penn told People magazine. "The media has mixed my words up. What I said was, I was asked, generically, would I consider marriage again. And I said that I would. That I was not, because of two failed marriages, closed to marriage . . . I did not declare anything. Neither did she. We're just living our life."

Meanwhile, Theron's trip Down Under at the weekend has been marred by reports her entourage kicked up a fuss over her using shared toilets at the Grand Prix.

The blonde was in town to promote the $500 million Capitol Grand development and her minders apparently requested the rest rooms at the Skydeck be roped off for her private use.

When that could not be accommodated, her team reportedly demanded the area be cleaned multiple times before she would use the facilities.

The day was not without other dramas, with Theron's scheduled interviews cancelled at the last minute and the actress mistakenly referring to Capitol Grand as Capitol Hill.
