They might be calling for her to be arrested in New York but *Lara Bingle *was all smiles as she lapped up the sunshine in her native Sydney yesterday morning.

The model and girlfriend of *Rockingham *-raised actor *Sam Worthington *is back in Sydney to complete a court- ordered driver's course for multiple driving offences.

Paparazzo *Sheng Li *claims he has been unable to work after suffering wrist and back injuries in a "brutal attack" by Worthington and Bingle in New York on February 23.

Li, wearing a wrist brace, appeared before a judge in Manhattan's Criminal Court on Tuesday, where his lawyer *Mark Heller *told the New York Post the snapper had "some serious medical injuries" to his hand from the stoush.

"As a result he may have to go in for a very extensive and expensive operation and he may be deprived of earning a living in the future," Heller said of his client.

Li and Worthington were charged with assault and harassment counts after the incident in Greenwich Village, where the Avatar hunk reportedly "punched" Li for allegedly kicking Bingle in the shin.

Bingle was not charged but Heller is lobbying for her to be prosecuted, describing her as the "aggressor".

"There has to be a warrant issued for her arrest, she has to be charged with a felony assault and attempted robbery," the lawyer said.

Li refused the prosecution's offer to dismiss the charges in six months if he kept out of trouble and abided by an order of protection. Heller wants an unconditional dismissal.
