NRW, Samsung fight may go to umpire

NRW Holdings says formal talks with Samsung C&T over a Roy Hill contract will determine whether the prolonged payment row ends up before a Singapore umpire.

Responding to a _WestBusiness _ report on Monday, the earthmoving contractor said it had issued notices of dispute under the contract which required the parties to negotiate.

"Whether arbitration proceedings at the Singapore International Arbitration Centre commence will depend upon the outcome of the conferences," NRW said.

The dispute notification follows at least six months of talks in which the two sides failed to resolve their conflicting claims.

Samsung is head contractor at the $10 billion iron ore project in the Pilbara. NRW is making claims for extra work and scope on the $620 million contract.

NRW said Samsung had made progress payments on the completed rail formation project until February but not the most recent March claim, due at the end of last month.
