The driver who caused the crash which has left Tracy Morgan in intensive care has been charged with death by auto.

Kevin Roper faces one count of death by auto and four counts of assault by auto after the crash, which saw the Walmart truck he was driving plough into the 30 Rock star's limo bus, overturning it.

Five other people were inside the truck with Tracy, right, and six vehicles in total were involved in the crash, on the New Jersey Turnpike.

Morgan, 45, was airlifted to Robert Wood Johnson Medical Centre in New Brunswick and is in critical condition, alongside his friend and travelling partner Ardie Fuqua.

Another passenger, Morgan's friend and collaborator James "Uncle Jimmy Mack" McNair, 63, was pronounced dead at the scene.

Walmart chief executive Bill Simon has said the company will pay the expenses of the victims of the crash if its driver is found to be at fault.

"This is a tragedy and we are profoundly sorry that one of our trucks was involved," Simon said.

"We can't change what happened, but we will do what's right for the family of the victim and the survivors in the days and weeks ahead."

Morgan, who got his break as a standout regular on Saturday Night Live, was scheduled to perform at a casino in Dover, Delaware, on Friday night and was believed to be travelling back home to Bergen County, New Jersey, when the collision happened.
