Rapper *Kanye West *and his fiancee *Kim Kardashian *have been given the green light to proceed with legal action against YouTube co-founder *Chad Hurley *, who is accused of leaking video footage of their engagement online.

The rapper and reality TV star filed the lawsuit against Hurley last year.

They claim Hurley crashed their engagement at AT&T Park in San Francisco in October, and then breached a confidentiality agreement he had

signed by secretly videotaping the romantic moment and posting the footage on his MixBit website.

Hurley attempted to fight the lawsuit, claiming it should be dismissed on the grounds of free speech.

However, Superior Court Judge *Ruth Ann Kwan *rejected Hurley's dismissal motion on Tuesday, insisting the one-page document he had signed clearly stated it was a confidentiality agreement.

West and Kardashian, left, are seeking unspecified damages.

The elaborate proposal was filmed exclusively for the reality TV show Keeping Up With the Kardashians.
