'He kept popping up': Mehajer agrees not to harass or stalk wife in accordance with AVO

Former Auburn deputy mayor Salim Mehajer has agreed not to go within 50 metres of his wife in accordance with an apprehended violence order taken out by the NSW Police.

The order means the couple will not be allowed to be together on their first wedding anniversary next month.

The controversial councillor agreed to the AVO conditions in the Sydney Downing Centre local court Wednesday, including provisions stipulating he will not harass, assault, stalk or menace Aysha, who was listed on the application under her maiden name Learmonth.

According to a police source, Ms Learmonth told police Mr Mehajer kept "popping up where she is" and there were fears he could become violent, the Daily Mail reports.

Mr Mehajer's lawyer Matt Ward said his client objected to two conditions of the order, which state he cannot approach his reportedly estranged wife or go within 50 metres of her home or workplace.

He is also challenging the condition that has cannot make contact with the trained beautician except through her legal representative.

Ms Learmonth did not appear in court for the brief hearing of the AVO filed by police on Monday on her behalf.

The interim order will prevent the couple from being together on their first wedding anniversary on August 15, but the matter will return to court two days later when a hearing date will likely be set.

Police prosecutors must serve evidence to Mr Mehajer by July 27, giving him until August 10 to provide evidence in his defence.

The suspended former deputy mayor from Auburn council in Sydney's west confirmed he and his wife were no longer living together in their Lidcombe mansion, but they continue to see each other "every day".

"Only death will do us apart," he said of the marriage.

Mr Mehajher denied the AVO was taken out by his wife, telling reporters Tuesday it came about from "alleged complaints from neighbours".

He added their separation came from a reality TV show being in the works.

"Aysha and I are casting and preparing to be part of a TV series," Mr Mehajer told The Daily Mail Australia.

"She is currently in audition. At the moment we cannot disclose the show (or) series name."

Mr Mehajer his wife have not been seen in public together for several months but he continues to share pictures of the couple on social media.
