Melbourne mosque drive-by shooter jailed

A Victorian man who yelled out "run you bastard" after shooting another man outside a Melbourne mosque has been jailed for at least five years.

Omar Tiba, 31, shot Mohammed Oueida, who had just left the Coburg Islamic Centre, while riding in a BMW driven by his brother Osman in April 2017.

Mr Oueida was taken hospital with life-threatening injuries to his stomach and a 0.32-calibre bullet was removed from his body.

Tiba on Monday faced the Victorian Supreme Court, where he was sentenced to a total of seven-and-a-half years in prison.

The 31-year-old had pleaded guilty to intentionally causing serious injury in circumstances of gross violence, but argued that the shooting was "unplanned and impulsive".

Justice Christopher Beale was not convinced.

"I am far from satisfied the thought only entered your head when your brother drew up alongside him," Justice Beale said.

The court heard Tiba suffers from post-traumatic stress disorder after he was shot three times in the leg in January 2017.

Tiba must serve at least five years before being eligible for parole, but has already served nearly four years in custody after being arrested in October 2017.

His brother Osman was last year acquitted over the drive-by shooting after claiming he didn't know of Omar's intentions.
