Acting Fraser Coast Mayor George Seymour has claimed victory in the council's by-election days after sacked mayor Chris Loft had his review application dismissed.
Mr Seymour secured nearly 40 per cent of the vote on Sunday while Mr Loft had his application for judicial review of his dismissal denied on Friday at the Queensland Court of Appeal.
"I am looking forward to the challenges ahead," Mr Seymour wrote on Facebook following his win.
"The Fraser Coast is an amazing region and I will do everything I can to ensure the council is working on its behalf for the good of the community."
Mr Loft's axing was recommended in February by Local Government Minister Stirling Hinchliffe, who said he was unfit for office after misconduct allegations were levelled against him.
Mr Hinchliffe will this week look at ways to reform the system and is likely to seek greater powers to sack mayors and councillors who have been charged with criminal offences.
He will meet with the chair of the Crime and Corruption Commission Queensland and president of the Local Government Association Queensland ahead of Tuesday's cabinet meeting.
