Marriage poll High Court battle continues

The High Court has confirmed it will hear a challenge against the constitutionality of the federal government's same-sex marriage postal survey in Melbourne on September 5-6.

The court confirmed the dates in a directions hearing in Brisbane on Thursday.

The government has said it won't distribute any forms for the $122 million survey until the case is finalised.

Gay rights campaigners question the legal validity of the postal plebiscite and its cost, as well as the proposed role of the Australian Bureau of Statistics in the ballot.
