Manslaughter trial over breast op delayed

A Chinese tourist charged with manslaughter over the death of a Sydney beauty clinic owner will not face trial until next year.

Jie Shao was 33 at the time of working at the Medi Beauty Laser and Contour Clinic in Chippendale when she allegedly administered a local anaesthetic and breast fillers into Jean Huang.

The 35-year-old went into cardiac arrest and was immediately rushed to hospital but she died two days later in September 2017.

Shao had arrived in Australia just days before the alleged botched procedure and was due to face trial for manslaughter this week.

Judge Christopher O'Brien on Thursday adjourned the case following difficulty in getting permission from Chinese authorities for the Crown's key witness to give evidence via video link.

The Crown has undertaken to pay Shao's costs of over $55,000 resulting from the adjournment.

Defence lawyer Winston Terracini SC said his client had been unable to work due to strict bail conditions and had been privately funding her court battle.

He argued that the Crown was aware of its witness problem as early as January but only let his team know recently.

"We're ready to rock n' roll," Mr Terracini said in Sydney's Downing Centre District Court.

"This is a very serious matter."

Mr Terracini submitted the Crown had further issues with its case regarding another primary witness who left for Taiwan and said words to the effect: "You can whistle Dixie, I'm not coming back"

"So they have problems with AVL witnesses in Taiwan as well," Mr Terracini said.

Court documents alleged Shao had injected Ms Huang with varying amounts of anaesthetic in the form of Tramadol and Lidocaine and the restricted substance hyaluronic acid.

The court previously heard Shao was a graduate of a Canton medical university and a specialist in dermatology who had practised in China and Great Britain.

Judge O'Brien continued Shao's bail and set a new trial date of January 31, 2022, with an estimation duration of four to five weeks.
