Magistrate's husband to face assault trial

The husband of a Queensland magistrate is set to face trial for allegedly assaulting his neighbour.

David Joseph Pirie - the husband of Gold Coast-based magistrate Catherine Pirie - is expected to appear for the jury trial in Brisbane District Court, starting on Monday

Pirie was charged with one count of assault occasioning bodily harm after he allegedly hit a female neighbour in February last year.

The son of the woman allegedly attacked by Pirie - Shane Christopher Toohey - was charged in March 2017 with unlawful striking, threats of violence and act with intent to insult or offend after a separate incident involving Ms Pirie.

Toohey, who has been accused of threatening to rape and kill Ms Pirie, was released on bail in April.

David Pirie's trial is set to run for five days.
