Harvey Weinstein to stay in NY until retrial on sex crimes charges before serving California sentence
NEW YORK — Disgraced movie mogul Harvey Weinstein will stay in New York until he’s retried on sex crimes charges before being returned to California to serve out his sentence there, according to the Queens district attorney’s office.
Weinstein, who was present in Queens Criminal Court, was arraigned Monday on a warrant issued by Gov. Kathy Hochul.
“The defendant — who was convicted in California of forcible rape and other crimes — will be returned to the state of California after his case in New York County is completed,” DA Melinda Katz said in a statement.
“He will serve the California sentence first, as it is now his primary sentence.”
The fallen producer, who’s been splitting his time between Rikers Island and Bellevue Hospital, is set to face a retrial in Manhattan on Nov. 12 after the Court of Appeals overturned his landmark rape and sexual assault conviction from 2020 for sexually assaulting his former production assistant, Miriam Haley, in 2006 and raping Jessica Mann, an aspiring actress, in 2013.
New York’s highest court in April threw out the guilty verdicts that led to his 23-year sentence based on testimony provided by three women about uncharged instances of sexual violence.
Prosecutors for Manhattan District Attorney Alvin Bragg, who was not in office when Weinstein went on trial in New York, have said they may file a superseding indictment, including allegations from victims who were unprepared to go through the legal process the last time.
Following his New York trial, Weinstein was tried and convicted in Los Angeles on separate rape and sexual assault charges and sentenced to an additional 16 years.
The Manhattan DA’s office and Weinstein’s attorney, Arthur Aidala, did not immediately respond to requests for comment.
