Gwyneth Paltrow trial – live: Actor tells court she initially thought skiing accident was ‘sexual assault’

Gwyneth Paltrow says she briefly thought a 2016 ski collision was in fact a sexual assault and “froze” when a set of skis suddenly “forced my legs apart.”

Terry Sanderson, 76, has accused the Hollywood star of crashing into him on a ski slope at the Deer Valley resort in Park City, Utah, in February 2016, leaving him with “permanent traumatic brain injury, four broken ribs, pain, suffering, loss of enjoyment of life, emotional distress and disfigurement”.

Meanwhile, Paltrow claims it was Mr Sanderson who crashed into her — and that he told his daughter afterwards that he was “famous.” The Goop mogul is expected to be called on the stand by Mr Sanderson’s attorneys today.

In court on Thursday, Mr Sanderon’s lawyer Robert Sykes hit out at the star’s legal team for asking his daughter about claims by another daughter that their father was abusive.

Mr Sykes claimed that Paltrow’s team was only going down that route because the actor “is worried about the way this case is going”.

“You can’t just attack someone’s character because his client is worried about the way this case is going,” he said.

Mr Sanderson is seeking $300,000 from Paltrow while she is seeking a symbolic $1 in damages and for her legal fees to be covered.

Mr Sanderson alleges that Ms Paltrow was coming down the beginner slope of Bandana Run on Flagstaff mountain in an “out-of-control” manner, according to Court TV.

He claims that she struck him so hard that he was knocked out. At a press conference in 2019, he said that moments before the collision, he “heard this just hysterical screaming like … King Kong in the jungle or something”.

He said at the time that he thought the speed at which Ms Paltrow was allegedly coming at him could explain the extent of his injuries. “A little bitty bullet can make a big hole,” he said, according to The Salt Lake Tribune.

At that press conference announcing the lawsuit, Mr Sanderson said he noticed a number of large “slow down” signs as he headed down Bandana run, so he slowed down but still stayed with the flow of other skiers coming down the slope.

“It was just instantaneous,” he said in 2019. “I got hit in my back. ... It felt like it had just drove me forward.”

He said he could remember not being able to control himself as he went down.

“And then that’s all I remember to that point — just out,” he said.

And she said that she is now asking for more than a “symbolic $1.”

“For me, there is a delineation between the $1 I would receive and the lawyer fees being reimbursed,” she added.

“He did. when we fell over my right knee felt like it had been over-stretched and my back hurt,” she said.

The Hollywood star told the court she got a massage after the incident but did not have to seek any medical care.

Gwyneth Paltrow told the court on Friday afternoon under cross-examination that she felt “very sorry for” Terry Sanderson.

“It seems he has had a very difficult life but I did not cause the accident so I cannot be at fault for anything that subsequently happened to him,” she told the jury.

The actor also testified that she did not give Sanderson brain injuries that her defence lawyer says showed up on a 2006 MRI.

The court was shown a selfie photograph of Ms Paltrow and her son Moses on the ski lift on the day of the accident and she testified that she always wears a helmet when she skis for safety and for some anonymity.

“When I am skiing I like to try to keep a low profile,” she added.

She was also asked about her history of skiing with her father, who died when he was in his 50s, causing her to step away from the sport for a while.

“I was pretty devastated by his death and being in a ski resort or on a chairlift was difficult for me and I avoided it for a few years until I had my own kids and I heard his voice in my head telling me I should teach them to ski,” she said.

She told the court that her first husband Chris Martin of Coldplay, did not ski but she had started again with now husband Brad Falchuk in an attempt to “blend” their two families.

She added that she was not distracted and was paying attention to where she was skiing on the day of the accident.

Rumoured GoPro video footage of Gwyneth Paltrow’s ski collision may not actually exist, the court has heard on Friday.

Reference to footage of the 2016 incident had previously been made during the trial in an email sent by Mr Sanderson’s daughter.

The jury was previously shown an email, sent by Shae Sanderson-Herath, in which she referred to possible GoPro footage of the crash.

But giving evidence on Friday, Ms Sanderson-Herath said she had not actually seen any such footage, though she had believed it existed at the time.

“After my dad told me about what he was feeling and that he could hardly think, and that he had rung his bell I believe he mentioned, there had to be GoPro video,” she told the court.

“He said there has to be GoPro footage because there was this big blood-curdling scream, so that means someone with a GoPro would have turned to look and captured it.”

She added: “I have never seen GoPro video and I don’t know that it does exist. I believed there was GoPro video at the time and that’s why I said that.

“I just wanted my dad to have peace of mind that there was video out there that showed what happened.”

On Thursday, the court heard testimony from Mr Sanderson’s daughter, Polly Sanderson-Grasham.

Ms Sanderson-Grasham said her father had been a “fun-loving, gregarious” man prior to the incident, describing him as a “goer” and a “real positive influence”, as well as an experienced skier.

But she said seeing him at her own daughter’s graduation around three months after the skiing crash had been like a “slap in the face”.

“I felt like ‘wow’. There was a moment when I almost expected drool to come out of his mouth,” she said.

“He wasn’t engaged with anyone… that was my first slap in the face that something is terribly wrong.”

She added that her father could now not “see the forest for the trees” and got stuck “in the minutiae” of things.

“He’s easily frustrated, he gets agitated, angry – I didn’t have memory of him being an angry person but he’s got a pretty short fuse these days,” she said.

“I think he’s just a little more cautious, not as confident – he’s in a really negative place and that’s hard for me as his daughter.”

Ms Sanderson-Grasham later became emotional, telling the court: “I hope that (my father) moves on. I hope that we’re able to put this very strange chapter behind us.

“We don’t always choose the doors we walk through but we can choose how we walk through them. We have a lot of healing to do.”

In court on Friday, Mr Sanderson’s attorneys showed his daughter the picture of a park employee who took him to be evaluated in the immediate aftermath of the ski crash.

Mr Sanderson sent the picture to his daughter Shae once he was transported to the hospital.

“Whitney had me entertained while probing me with questions to evaluate my senses. A dedicated outdoor person and house lover from Michigan,” he wrote. “She also took me down to the toboggan by herself and won the DV Women Downhill race contest. A sweetheart”

“I recognize this woman’s smile and I do remember he had an awful day but this woman came to his rescue,” Shae testified. “She was his angel and took care of him finally, after a long time of being ignored in the mountain.”

The defence objected to the remarks, and the judge agreed that the comment should be stricken and disregarded by the jury.

Terry Sanderson provided “a cushion” for the Oscar-winning actress during the incident at the Deer Valley resort in Utah in 2016, jurors were told.

The retired optometrist is suing Ms Paltrow over the crash, in which he suffered several broken ribs and a severe concussion.

Ms Paltrow has denied the claim and is counter-suing Mr Sanderson, alleging it was him that caused the collision.

Both are expected to provide testimony at the trial on Friday.

On Thursday jurors heard testimony from Dr Richard Boehne, who said Mr Sanderson’s injuries could only have been caused by being struck from behind.

A neuropsychologist testifying for a man suing Gwyneth Paltrow over a 2016 skiing collision has lashed out at the defence’s claims that he is “exaggerating his injuries”.

Ms Paltrow is being sued by retired optometrist Dr Terry Sanderson, 76, who claims she ploughed into him on the slopes of Flagstaff Mountain at the Deer Valley Resort on 26 February 2016.

Mr Scanderson, who is demanding $300,000 in damages, says he was left with severe brain injuries that left him with “permanent traumatic brain injury, four broken ribs, pain, suffering, loss of enjoyment of life, emotional distress and disfigurement”.

On the third day of trial in Park City, Utah, psycho-neurologist Dr Alina Fong hit out at the defence’s claims that Mr Sanderson was exaggerating his symptoms to exploit Ms Paltrow’s celebrity status and wealth.

Dr Fong, who opened a clinic in Boston in partnership with Tom Brady, has diagnosed Mr Sanderson with PCS (persistent post-concussive symptoms), which she said happened after the accident.

Lawyer Stephen Owens admitted that he may have overstepped the mark while cross-examining Polly Sanderson Grasham – daughter of Terry Sanderson, the retired optometrist suing the Hollywood star and Goop CEO.

Dr Alena Fong challenged the opinions of other medical experts employed by Ms Paltrow’s defence, adding: “This has completely changed his life physically, emotionally, biologically – and he has been affected in all those domains.”

She said there was no evidence “whatsoever” that Mr Sanderson was “faking” his injuries and he had been “an ideal patient”.

She added: “Terry showed up to every appointment on time. He gave his best effort – the treatment is very intensive. He was an ideal patient… there was no issue with any of our therapists.

“In fact it was almost the opposite… Terry is a very intelligent man and he didn’t want to be injured… and was willing to do anything he could to change where he was at.”

Under questioning by Mr Sanderson’s attorneys, Dr Fong said she had advised Mr Sanderson to travel.

“I encouraged him to try to get back to doing things that he loved,” Dr Fong said. “I did caution him that he should not travel alone because of his memory issues and other problem-solving issues.”

She added: “But I did strongly recommend that he tried getting back to doing things that he loved.”

During opening arguments earlier this week, Ms Paltrow’s attorneys had tried to poke holes in Ms Sanderson’s claims by arguing that his injuries could not be as severe as he alleged if he was able to travel to “more than ten countries” after the 2016 ski collision.

Neuropsychologist Dr Sam Goldstein testified before the jury on Wednesday.

Dr Goldstein said the incident had caused an “acute rapid downturn” in Mr Sanderson’s behaviour and functioning that had not stemmed from pre-existing medical issues.

“Were it not for that particular accident, the life he was living (prior)… would be the life he would still be living,” Dr Goldstein said.

Neuro-radiology expert Dr Windell Gibby testified on Wednesday that the collision caused Terry Sanderson to “abruptly” suffer a sharp decline in quality of life – leaving him unable to enjoy his past times.

“Terry had been a high-functioning, active person... Meeting groups, wine tasting, skiing, volunteering,” she said.

“After the accident, he deteriorated abruptly and many of the activities he loved to do, he stopped doing.”

Dr Fong said that when she first met Mr Sanderson in 2017, he had presented “a myriad” of symptoms indicative of having suffered a concussion.

She said: “According to Terry’s report, these were quite significantly affecting his life. It was affecting his personal life, his relationships.

“It affected him on so many levels, especially for someone who was used to loving life… by the time he came to me that was pretty much gone.”

Dr Fong challenged the opinions of other medical experts employed by Ms Paltrow’s defence, adding: “This has completely changed his life physically, emotionally, biologically – and he has been affected in all those domains.”

She added: “They have a lot of opinions and it just shows that they’re not concussion experts, specifically traumatic brain injury experts and If I’m being completely honest a lot of their opinions are easily refutable by just going online and looking at the CDC’s recommendations for clinicians on how to treat concussions.”

Experts hired by the defence have yet to testify, but during opening arguments earlier this week, Ms Paltrow’s attorneys have claimed that Mr Sanderson’s story is “utter BS.”

“He was someone who didn’t want to be sick and was doing everything he could do to improve where he was at.”

Experts for Mr Sanderson say 2016 ski collision caused current symptoms

Wendell Gibby and Sam Goldstein — a radiologist and neuropsychologist — testified on Wednesday.

Dr Gibby and Dr Goldstein have previously appeared as expert witnesses for Sanderson, who has said he broke ribs and sustained brain damage from the crash. Thus far, attorneys have argued over whether Sanderson’s medical problems stemmed from the crash or were merely a byproduct of ageing.

“In a chronology, looking at all the records and evaluating Mr Sanderson, the one event that would appear to acutely lead to the symptoms he was presenting is this particular accident,” Dr Goldstein said. “The ski accident.”

Both parties blame the other for the collision and claim they were crashed into from behind, relying on a little-known Utah law stipulating that whoever is downhill has the right of way when skiing and snowboarding.

Paltrow’s attorneys have asked Judge Kent Holmberg to enact special restrictions throughout the actor-turned-wellness tycoon’s trial, while she has used a blue notebook to shield her face from view when entering and exiting the courtroom.

Mr Sanderson is arguing that Ms Paltrow is essentially guilty of the accident. In his complaint filed in 2019, he alleges that after the collision, she “got up, turned and skied away, leaving Sanderson stunned, lying in the snow, seriously injured”.

“A Deer Valley ski instructor, who had been training Ms. Paltrow, but who did not see the crash, skied over, saw the injured Sanderson and skied off, falsely accusing Sanderson of having caused the crash,” the complaint states.

Ms Paltrow on the other hand, claims that her instructor did in fact witness the collision.

The rule of the hills in Utah is that those ahead of you have the right of way and that those coming from behind have to avoid others. Both Mr Sanderson and Ms Paltrow claim that they were lower down on the mountain.

Deer Valley adheres to the National Ski Areas Association responsibility code, which also says that all skiers must be in control and able to stop as well as avoid other skiers.

A 2016 ski crash with actor Gwyneth Paltrow caused a man to suffer long-term injuries, including to his mental health and cognitive ability, a Utah court heard on Wednesday, during a second day of testimony in a Park City courthouse.

Retired optometrist Terry Sanderson is seeking $300,000 in damages for the impact of a collision between the two at the Deer Valley resort in Utah, which experts testified left the now 76-year-old with lasting damage.

Radiologist Dr Wendell Gibby, who examined Mr Sanderson, told the court the man had the “typical hallmarks” of a brain injury, and his quality of life “deteriorated abruptly” following the crash, drastically changing things for the typically “very high-functioning, high-energy person.”

Ms Paltrow says in her pre-trial filing that Mr Sanderson’s injuries are exaggerated because an examination was conducted with his doctor, which didn’t reveal anything lacking in his cognitive functioning, the claim says.

The movie star’s filing states that medical records show that he was diagnosed with a “mild” concussion and that he has spent “extended periods of time” on vacation abroad following the crash.

The counterclaim also alleges that Mr Sanderson had 15 chronic medical problems and that he had told his physician a year previously that he was blind in his right eye, and that the vision in his left eye was getting worse.

“She did not knock him down or cause him to suffer a concussion, brain injury, or broken ribs,” Ms Paltrow’s filing states.

Doctor says man in Gwyneth Paltrow ski accident can’t enjoy wine tasting anymore

Terry Sanderson, a retired optometrist, claims a 2016 ski crash with Gwyneth Paltrow left him with permanent injuries that altered his quality of life.

“Terry had been a high-functioning, active person,” Dr Wendell Gibby, a neuroradiology expert, said of Mr Sanderson’s injuries during testimony on Wednesday. “Every day he was doing lots of things. Meeting groups, wine tasting, skiing, volunteering.”

“After the accident, he deteriorated abruptly and many of the activities he loved to do, he stopped doing,” the expert added.

Ms Paltrow has asserted it was Mr Sanderson who crashed into her.
