A man who served time for possessing child abuse material has been charged with the alleged sexual assault of a 14-year-old in a playground toilet.

Detectives from the NSW Police Child Abuse Squad began investigating after the girl reported she had been sexually assaulted by a man she did not know at Pole Depot Park in Penshurst in on Monday morning.

The young girl was allegedly led into a playground toilet by the 46-year-old man who is then accused of assaulting her, 7 News reported.

NCA Newswire has confirmed the man had been in prison from May to August last year after being convicted of possessing child sexual abuse material.

Despite his that conviction, it’s understood the man was allowed to live near the playground due to the short length of his sentence as he was placed on automatic court-based parole upon release.

Police set up a crime scene at the Penshurst park before their investigations led them to a nearby home where they arrested the 46-year-old.

He was taken to Kogarah Police Station and charged with five offences, including producing child abuse material, aggravated sexual intercourse with a child more than 14 years and under 16 years, and using a child over 14 years to make child abuse material.

He was refused bail to appear at Sutherland Local Court on Tuesday where he was formally refused bail to appear in court in October.
