Driver charged with killing woman was 'receiving sex act' at the time

An alleged drunk driver was reportedly receiving oral sex when he reversed his ute into pedestrians killing a woman.

Alex Moreno, 32, was allegedly drunk when in his parked 2017 Chevrolet Silverado he accidentally reversed "at a high speed" and hit three outdoor diners at the Agave Sports Bar and Grill Restaurant in San Jose, California last Friday at about 11pm, police said.

“All three patrons were transported to a local hospital,” police said.

“The adult female was pronounced deceased at the hospital. The two adult male victims suffered non life-threatening injuries.”

Moreno has been charged with felony DUI and gross vehicular manslaughter.

According to court documents seen by East Bay Times, Moreno was receiving oral sex at the time of the crash.

Police confirmed there was a female passenger in the 32-year-old's car. 

Moreno had also been asked to leave the bar before the crash.

He remains in custody.

The female passenger was uninjured and has not been charged with an offence.

Friends and family identified the woman who died to Spanish language TV network Telemundo 48 as 35-year-old Diana Prieto.

It’s believed Ms Prieto was working at the restaurant when she died but that’s yet to be confirmed.

An unnamed friend told Telemundo 48 Ms Prieto had only arrived in the country three weeks ago from Colombia.

"It was one of those shocking news, that being in a sitting place and something like this absurd happened," the friend said.
