Tyson Dagley was facing jail after a fatal jet-ski accident in Hawaii. Although he is coming home, his torment is far from over.

Mr Dagley, a carpet cleaner from Crestmead in Brisbane's south west, was released from a 12-day stint in Hawaii's notorious O'CCC jail after being charged with third degree negligent homicide.

A judge later sentenced him to time already served after the 20-year-old entered a plea of no contest.

He was allowed to return to Australia on the equivalent of a good behaviour bond.

He was also ordered to pay the Fonseca family $76,500 restitution but it is understood the Fonseca family will pursue civil action.

It's a story with no real end for two families; one wanting justice for their daughter, the other wanting peace for their son.
