Jury deliberates in case of alleged taxi rape

A Perth jury has started deliberating in the case of two taxi drivers who deny raping a female passenger as she made her way home from a boozy hen's night.

Amrit Pal Singh and Prabhjit Singh Gill are fighting charges of sexual penetration without consent, with the prosecution arguing that the pair had sex with the woman knowing that she was too intoxicated to be able to consent.

The District Court Jury had been told the woman drank more than two bottles of champagne during the celebrations in February last year and had been denied entry to a nightclub before getting in to Mr Singh's taxi.

The woman gave evidence that the next morning she had flashbacks of a man, allegedly Mr Gill, trying to have sex with her.

The court had been told that she had passed out when she arrived home to her husband following the night out.

Mr Singh testified that he had resisted the woman's advances during the cab ride before she directed him to a North Lake car park and initiated sex, despite him not having any condoms.

His lawyer, Steven Shadgett, is arguing that his client had reasonable belief that she was not too drunk to consent

Mr Gill denied having any sexual contact with the woman and testified that he had only gone to the car park to deliver drinks to Mr Singh.

Mr Gill told the jury he had asked the woman to move away when she put her arm around his neck while thanking him for the drinks.

He agreed he had seen and heard Mr Singh and the woman having sex but rejected suggestions that he was next in line and that the pair had planned the alleged rape.
