The Liberal backbencher has apologised for her "error of judgement" releasing a short statement to the Herald Sun on Friday.

"Last night, while driving, I looked at my phone. This was obviously the wrong thing to do and I apologise for this error of judgment," the statement said.

A Victoria Police spokesperson released a statement to Yahoo7 saying the matter has been referred to local police.

"Victoria Police were contacted by Ms Henderson yesterday in relation to the alleged use of her mobile phone while driving a motor vehicle on the Surf Cost Highway.

"Ms Henderson is fully cooperating with Victoria Police and the matter has been referred to local police to follow up.

"All Victorians are reminded that distraction is a major cause of collisions and we ask every driver to show restraint in the use of mobile phones while driving a motor vehicle.

Ms Henderson is a member of the Liberal Party of Australia and began her career as a journalist before moving into commercial law.

Her lapse in judgement comes just days after Opposition Leader Bill Shorten was filmed using his phone while driving.

He was fined $445 and lost four demerit points before making a public apology.
