Driver loophole may lead to thousands dodging speeding fines in NSW

An Australian court will decide before Christmas on a case which could allow many NSW drivers to dodge their speeding fines.

The case surrounds the certification of police hand held radar guns, after a driver questioned why there was nothing to say whether a gun was accurate or reliable.

In February Furio Rossi allegedly clocked 101 KPH in a 50 zone, which resulted in a fine of more than $2000.

In court Mr Rossi’s lawyer claimed police failed to produce documents which certified that the radar gun used was ‘accurate and reliable’.

Prosecutors were forced to adjourn.

The lawyer claimed the result could cost the State Government hundreds of thousands of dollars, allowing hundreds of drivers to challenge their speeding fines.

But despite this police said they were still ‘very confident’ in their equipment with prosecutors saying they will be back in court in November with more evidence.

Even if the police have made a mistake or there is a problem with the paperwork there are other ways to prosecute speeding matters like this such as estimating speed.

The decision is likely to be heard on November 22.
