The President of Tasmania's Legislative Council has received advice that Elwick independent Terry Martin will apply for leave while he faces criminal charges.

Martin first appeared in court a week ago on charges of having sexual intercourse with a young person, and of producing and possessing child exploitation material.

Council president, Sue Smith, says the clerk of the council has received communication from Martin's office.

Mrs Smith says a written application for leave of absence is expected on Monday and council members will vote on it the next day.
