Former NRL star Greg Bird and his American girlfriend, whom he was convicted of glassing in the face, both want to give evidence at his appeal hearing in November.
In June, Bird was sentenced to at least eight months' jail after being convicted of recklessly wounding paralegal Katie Milligan, who suffered a fractured eye socket and cuts to her eye when she was hit in the face with a glass last August.
Magistrate Roger Clisdell set a maximum jail term of 16 months but immediately granted Bird bail pending his appeal.
Bird has since been captaining French side Catalans Dragons in the English Super League.
Ms Milligan, who has stood by her man, did not give evidence at his trial but did provide a glowing character reference at his sentencing hearing.
She described Bird as "one of the most loving, sensitive and yet principled men I have ever met".
At the NSW District Court on Wednesday, Bird's barrister Peter Kulevski requested an adjournment to allow time for witness statements to be taken from the pair.
"Mr Bird was convicted in a prosecution case that was circumstantial - neither of the protagonists (gave evidence)," Mr Kulevski said.
"They are now willing, and desire to give evidence.
"There were two people in the room, neither of whom gave evidence ... it's plainly in the interests of justice that if the person who was the victim wishes to now give evidence, she should be able to do so."
Mr Kulevski said their new evidence had the potential to exculpate Bird.
Prosecutors did not oppose the adjournment, but indicated they thought the bid for fresh evidence to be allowed would fail.
Judge Michael Finnane adjourned the matter until November 5. The appeal hearing is set down for November 23.
