Regulator takes builder, workers to court
The federal workplace regulator is taking legal action against a builder, workers and a union over an illegal strike in Brisbane.
Fair Work Building and Construction (FWBC) has launched proceedings against Hutchinson Builders, 51 workers and the Construction, Forestry, Mining and Energy Union (CFMEU) in the Federal Court over the action.
The regulator alleges workers on a South Brisbane apartment block construction site downed tools on the command of a CFMEU organiser in December last year.
FWBC alleges the organiser told the workers two government compliance officers were coming to audit the site and they had to stop work.
It says 51 workers, including 14 employees of Hutchinson Builders, went to the lunch room for about 45 minutes.
Hutchinson Builders also allegedly paid their 14 employees despite their alleged illegal actions.
FWBC director Nigel Hadgkiss said on Thursday the regulator would take legal action against any company, union or employee that breached the Fair Work Act.
"Calling a strike because of government officials attending a site cannot be condoned," he said.
"This is one example that FWBC is prepared to take on employers as well as unions and individuals.
"If the law is broken at all levels, FWBC will take action at all levels."
