It is unclear whether ACT Chief Magistrate Ron Cahill will sit on the bench today after confirmation that police are investigating his conduct.

Attorney-General Simon Corbell was alerted to an allegation concerning the administration of justice involving the Chief Magistrate on October 23.

He referred the mater to the Office of the Director of Public Prosecutions who in turn passed it on to police.

It has been reported in the media that the alleged conduct relates to a hearing that was adjourned last week after a visiting Victorian Magistrate was allegedly given documents briefing him about the case.

Police would not confirm that yesterday.

Mr Corbell says he is seeking advice about how to respond to the investigation and will not say whether the Government plans to hold a judicial inquiry.

He also refused to be drawn on whether it was appropriate for Chief Magistrate Cahill to stand down during the investigation.

He says he hopes to make a further announcement later this week.

The Liberals have asked for a briefing on the matter.

The allegations come just a month out from Chief Magistrate Cahill retirement.
